Consumers in the EU still face discrimination based on the geographical location of their bank accounts, despite the 2014 Single Euro Payments Area (SEPA) Regulation prohibiting such practices. This was detailed in a new report published by the European Court of Auditors (ECA).<\/p>\n\n\n\n
This form of discrimination, known as “IBAN discrimination,” occurs when a company or organization refuses to accept SEPA transfers because the IBAN originates from an EU\/EEA country other than the institution’s base country.<\/p>\n\n\n\n
“IBAN discrimination can pose a serious problem for consumers. It forces them to open multiple bank accounts in different member states or complicates access to innovative financial services from fintech companies,” said Anna Martin, head of financial services at the European Consumer Organization (BEUC), in comments to Euronews.<\/p>\n\n\n\n
The ECA, based in Luxembourg, noted that efforts by the European Commission to tackle the issue have been hindered by regulatory loopholes and variations in penalties for violations. Minimum fines for discrimination range from \u20ac250 to \u20ac10,000, while maximum penalties can reach up to \u20ac10 million or 10% of a company\u2019s annual turnover.<\/p>\n\n\n\n
IBAN discrimination has also led to the rise of virtual IBANs, which the European Banking Authority (EBA) warns pose risks related to money laundering, deposit protection, fraud, and authorization.<\/p>\n\n\n\n
“Virtual IBANs cannot be a long-term solution to this issue as they create confusion for consumers regarding legal protections, such as the right to refunds in cases of fraud or deposit safeguarding in the event of insolvency,” added Martin.<\/p>\n\n\n\n
The European Commission acknowledged that even a decade after the SEPA regulation was introduced, IBAN discrimination remains unresolved. However, the EU’s executive arm emphasized that the issue is not pervasive across the entire bloc.<\/p>\n\n\n\n
According to the “Accept My IBAN” initiative led by fintech company Wise, most documented cases of discrimination in 2023 involved Germany, Spain, France, and Italy. However, these estimates are conservative as complaints can be filed through numerous channels.<\/p>\n\n\n\n
The European Fintech Association (EFA) has stated that the key to solving the issue lies in stronger and harmonized penalties across member states, along with effective monitoring and enforcement of the SEPA regulation.<\/p>\n\n\n\n
Fanny Rodriguez, a board member of the European Third Party Providers Association (ETPPA), underscored the need for more proactive application of existing rules at the local level.<\/p>\n\n\n\n
An ideal solution, according to the EFA, would be the implementation of a single IBAN system for the entire EU, which would facilitate the integration of a unified market and eliminate fragmentation.<\/p>\n\n\n\n
The European Commission has acknowledged these recommendations but stressed that their success depends on the resolve of national authorities to implement effective deterrents and punitive measures at their levels.<\/p>\n","protected":false},"featured_media":4591,"template":"","class_list":["post-4541","news","type-news","status-publish","has-post-thumbnail","hentry"],"acf":[],"yoast_head":"\n
